Passenger rights delayed or canceled by Air Antilles Express

Any traveler using air transport will one day be faced with a situation in which his flight is either delayed or outright canceled.

Texts and in particular the international convention of Warsaw but also the Regulation (EC) n ° 261/2004 protect you and oblige in the majority of the cases, the airline company to compensate you;

However, certain conditions must be met in order for you to be able to claim this compensation, which is then paid by the companies without any difficulty.

At the end of the provisions of article 1 paragraph 1 of the text: “This Convention applies to any international transport of people, baggage or goods, carried out by aircraft against remuneration. It also applies to free transport carried out by aircraft.

As soon as you can justify a transport to the departure and / or the arrival of a country signatory of the said Convention, this one will apply

The aforementioned EC regulation applies to transport under the following conditions:

As soon as you leave French territory from a French airport or any other European territory (Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Slovakia, Slovenia, Sweden) but also from Norway, Iceland or Switzerland, whatever the nationality of the air carrier , and whatever the destination of the flight, you can claim compensation based on the elements developed below;

Different conditions giving rise to financial compensation:

First of all, Air Antilles is required to inform you of the rights you have, the rules of compensation and assistance that you can assert; As such, it must make available to passengers an informative notice presenting these elements;

– In case of significant delay:

In this case, the text provides for compensation packages which depend, among other things, on the duration of the delay (less than or more than 2 hours on departure) and the distance of the trip (more or less 1,500 km) – the amounts of compensation can range from 250 euros to 600 euros.
In addition, the passenger who reaches his final destination more than 3 hours after that initially planned can also claim this compensation.

  – Flight canceled without notice:

If the flight is canceled, several options are available to the injured passenger:
Air Antilles can offer re-routing by another means of transport, or another flight;
In the event of rejection by the passenger and only if the latter renounces his journey, the French company must then reimburse the price of his ticket;

– Other cases giving access to compensation:

Your complaint must be produced within a specific time, and in priority to the company, which failing this may oppose you an end of non-receipt;

The carrier may always try to invoke a cause exempting from liability, by invoking a cause which is foreign to it, in an attempt to evade its obligation of compensation;

Finally, and in the event of disagreement with the company, you then have the possibility of contacting compensation experts with the capacity to process claims for compensation files regardless of the name or nationality of the operating company.

If these experts don’t get compensation on your delayed plane, they don’t charge any fees. If successful, they receive a sum of 30% including tax of the total amount obtained.

It is indeed not easy to know if one is entitled to compensation, what should be its amount and how to get it. Especially since companies often balk at informing their passengers. This is why startups are committed to respecting the rights of air consumers by carrying out for them this process which can be long and complex.
