Variable compensation in the event of damage arising from an Air Armenia flight delay
Flight delays follow a precise compensation schedule. However, the airline may invoke an external cause, or a case of force majeure, not to pay compensation (for example, a storm).
For a delay of two hours or more on flights of 1,500 km or less, the lump sum compensation is 250 euros. It increases to 400 euros for delays of three hours or more on flights over 1,500 km to 3,500 km, and on all intra-Community flights of over 1,500 kilometers (including flights between mainland and Guadeloupe, Martinique, Guyana, Reunion and Mayotte). For delays of four hours or more on flights over 3,500 km, compensation is 600 euros per passenger.
Compensation with travel vouchers?
The carrier is required to pay compensation in cash or by any other means (check, transfer). Compensation in the form of travel vouchers or credit notes can only be made with the written consent of the passenger.
Late flights: airline tip to avoid compensating passengers
Passengers on a flight are three hours late for compensation. Problem: airlines do not always respect the rules for calculating flight times.
Time is money. Especially for an airline when it comes to compensating passengers whose flight arrives beyond the scheduled time. The European Union imposes financial compensation on passengers three hours late. But to benefit from it, you still need to know how to calculate the duration of a flight.
Does your trip end when the plane’s wheels touch the runway? Or when the plane is stopped at its parking point? A difference that is anything but anecdotal. “Between the time the plane rolls on the tarmac and the time it arrives at its parking lot, it can take several minutes. It all depends on the size of the airport and the traffic. ” A few minutes that can make the difference between a compensation check of at least 250 euros,… or nothing at all.
In its judgment of September 2014, the Court of Justice of the European Union (CJEU), based in Luxembourg, decided that the flight is ended once the plane is stopped, at its parking point and that at least a door is open. “It is only when passengers are authorized to leave the aircraft and when orders to open the aircraft doors are given for this purpose that passengers can in principle resume their normal activities without having to undergo these constraints ”, justifies the CJEU.
A useful clarification provided that it is respected by air carriers including Air Armenia. Air passengers. It is not uncommon for companies to indicate that the plane arrived 2:58 late or 2:59 to escape their responsibilities. Some low cost or traditional companies like Air Arménia go even further by taking as arrival time the moment when the plane touches the runway. They rely on the ignorance of the passengers.
Being compensated, what procedure allows you to win your case?
To be compensated, you must send a claim for compensation to a company specializing in compensation. The latter, for example, charges a commission of 25% in the event of compensation, a percentage lower than that practiced by many other actors.
