Air Guyane and other airlines delays, passenger rights and remedies
Given the number of questions received from our fellow citizens who are victims of delays by Air Guyane and the airlines, we provide some information below concerning their right and recourse for compensation.
What the law says ?
EU regulation n ° 261/2004 states that from a delay of 3 hours on arrival (including connections), passengers can receive compensation. In addition to this compensation, the text also provides for compulsory assistance from the airline. This support (meal, drink, accommodation) must be reimbursed by the airline if it is not provided
Important: This obligation applies regardless of the airport of departure and arrival if the company is a national of an EU country. In the case of companies outside the EU (such as Air Guyane), the legislation only applies if the departure airport is in the EU.
Other conditions to respect
– Claim for compensation and variable periods depending on the country: In France, the claim must be made within five years of the date of the flight. In Belgium this period is one year and 3 years in Italy
– Airplane delay and airline responsibility: The cause of the delay must be the airline’s fault. To clear customs, airlines often use the excuse of “extraordinary circumstances”, but this is not always the case. In the event of litigation, know that there are databases capable of scientifically verifying the causes.
Amounts of compensation
– 250 € for flights up to 1500 km (= flights from France and Italy to any destination,
– 400 € for non-EU flights with a distance between 1,500 and 3,500 km (flights from Germany, Sweden, Ukraine to any destination),
– 600 € for other flights (long-haul).
What passengers must do to succeed:
–Keep all travel documents proving that you were a passenger on the flight:
– Boarding pass (important to keep),
– Electronic ticket,
– Reservation confirmation,
– Baggage tag,
– Certificate of delay (if provided by the airline).
