Cancellation and flight delay Aurigny Air Services: a tip allows you to receive better compensation

a decision of the Court of Justice of the European Union has just extended the right to compensation in the event of delay (more than 3 hours) or cancellation of a flight. In addition to the flat-rate compensation (250 euros for flights of less than 1,500km, 400 euros between 1,500 and 3,500km, 600 euros beyond), the Court’s decision takes account of additional potential damage: the loss of income due to missed work days, loss of a hotel reservation, car rental.
The Court informs, however, that this additional reparation is not compulsory according to European regulations, but only permitted! The Court has made it clear that this is the sovereign power of national judges.

Compensation up to 600 euros in your pocket

Compensation will be due from two hours for flights of less than 1,500 km, and three hours for flights from 1,500 km to 3,500 km (as well as all intra-Community flights of more than 1,500 km). Finally, for flights over 3,500 km, you must be at least four hours late.

The compensation received will then be 250 euros per passenger for journeys of less than 1,500 km, 400 euros for those between 1,500 km and 3,500 km (as well as for all intra-Community flights of more than 1,500 km; c ‘is in particular the case of flights between mainland France and the overseas departments which are considered as intra-Community flights).

Finally, the compensation will be 600 euros beyond 3,500 km for non-EU destinations.

To be reimbursed for your ticket, and therefore to waive your trip, your delay must be greater than five hours. At the same time, you can request to be redirected free of charge to your departure point. This is particularly the case for connecting travelers. For cancellations, the amount of compensation is the same as for delays.

Exceptions to the rule

Only downside, no compensation can be claimed from Aurigny Air if the cancellation is announced to you two weeks before the departure time or, in the event of a shorter delay, if a seat is offered to you on another flight at an hour close to schedules originally planned.

The company can also refrain from paying compensation if it proves that the cancellation is due to extraordinary circumstances. A concept which some carriers use and abuse. Be aware, a strike is not an exceptional circumstance. The European Court of Justice has ruled: in the event of social unrest in a company, the latter is required to compensate you if you meet the conditions.
