What are the conditions for being entitled to compensation for an aircraft delay?

To benefit from compensation, the delay must take place only at the time of arrival at the destination. Even if your plane takes off with a big delay but managed to catch up with the time, you are not entitled to anything or possibly a free pick-up while waiting, or even the refund of your ticket.

In all cases, the arrival must be at least 3 hours late.

– Departure from an EU country, Switzerland, Iceland or Norway: you are entitled to financial compensation, regardless of the company and the stops,

– Departure from a non-EU country to the EU, Iceland, Norway or Switzerland: you are entitled to compensation only if the company is part of the EU (as in the case of China Southern),

– Departure and arrival to a country outside the EU: only the conditions of the country of departure apply,

Please note: in the event of force majeure (natural disaster, epidemic or any other unforeseeable event), compensation cannot take place. In the case of a strike, only those outside the staff are considered force majeure.

How much can you get?

The amount of compensation for a China Southern aircraft delay depends on the distance of the flight.

– For a journey up to 1,500 km: € 250, departure or arrival in the EU.

– from 1,500 to 3,500 km: € 400, departure or arrival in the EU.

– more than 3,500 km: € 400 within the EU and € 600 between the EU and another country.

Reminder: For a flight with departure and arrival outside the EU, refer to the country of departure.

Your flight with the Chinese company is saturated: what are your rights in the event of overbooking?

When you arrive at the airport, you learn that the seats on your China Southern flight are already occupied. Too many seats have been sold, so not everyone will be able to board. Very often, the Asian airline company spontaneously offers passengers to delay their departure. Whether you accept or reject this offer, find out your rights.

You have agreed to delay your trip, what are your rights?

You are considered a voluntary passenger and you must therefore negotiate your services with the air carrier.
You can therefore choose between:

– re-routing by another flight,

– reimbursement of the ticket only if you give up undertaking the journey.

You do not want to delay your departure, what are your rights?

You benefit :

– the choice between re-routing by another flight and reimbursement of the ticket,

– taking charge of your re-routing (refreshments, catering, two communications, accommodation, transfers),

– the right to immediate compensation.

How to get your compensation?

You have to write to the airline or the travel agency. However, air carriers do not take complaints from their customers seriously because they know they are going to give up on everything and find themselves having to go through a lengthy and potentially endless process.

Why don’t you use the compensation specialists?
