Flight delayed, canceled or overbooked by Ewa Air: The best solutions to be compensated
We cross our fingers, we touch wood and everything else, but to date, we have never had big problems with overbooking, delayed flight, worse, canceled flight … But we are never at shelters of this type of situation and few people know that you can get up to € 600 compensation.
In fact, the rights of air passengers are framed by regulation EC N ° 261/2004 of the European Parliament which establishes the rules regarding assistance and compensation of passengers in the event of a delayed, canceled flight or in the event of refusal boarding (overbooking) caused by Ewa Air. Note that this law applies depending on the origin and destination of the flight as well as the nationality of the airline.
To assert your rights, the procedures are often very long and the airlines often deliberately allow the procedure to go on. Compensation in the event of overbooking
If you show up at the airport and there is overbooking, i.e. when the airline has sold more tickets than the number of seats available on the plane, the latter may ask if there is has volunteers to renounce their reservation against assistance (meal, refreshment, 2 phone calls and accommodation if the next flight takes place the next day) and compensation (negotiation between the company and the passenger). If there are not enough volunteers, the French airline can refuse boarding to passengers against their will. In this case, it is possible to obtain compensation depending on the distance traveled in and out of the European Union.
– Less than 1500 km: 250 €;
– from 1,500 km to 3,500 km: € 400;
– More than 3,500 km: € 600.
Compensation in the event of a canceled flight
If your flight is canceled and the airline notifies you less than 15 days before the departure date, the latter must offer you an alternative solution at no additional cost to reach your destination as quickly as possible. You can also benefit from up to € 600 in compensation depending on the distance from your final destination, unless the company plans to redirect you at the earliest 2 hours before the scheduled departure and at the latest 4 hours after the hour of initial arrival. If the airline notifies you less than 7 days before departure and it offers to re-route you at the earliest 1 hour before the scheduled departure and at the latest 2 hours after the scheduled arrival time, in this case you cannot receive compensation.
But still, the carrier is not under the obligation to compensate you if the cancellation of the flight is due to an “extraordinary circumstance” such as for example weather conditions dangerous for the safety of the passengers, a strike of the personnel of the airport, an unforeseeable failure.
Compensation for delayed theft
If your flight is delayed by more than 3 hours, then you are entitled to compensation calculated according to the distance, unless the delay is due to an extraordinary circumstance.
