Passengers on a connecting flight must be compensated when they arrive at their final destination with a delay of at least three hours from the scheduled arrival time.
If it was already known that an air passenger can be compensated when he arrives at his final destination with a delay of three hours or more compared to the arrival time initially planned.
The Court of Justice of the European Union (ECJ) goes even further by extending the reimbursement to connecting flights.
The Court recalled first of all that the regulation grants rights to air passengers when they are faced with a denied boarding against their will, a cancellation of their flight and, finally, the delay of their flight. In its view, therefore, in the case of a connecting flight, the lump sum compensation must be assessed in relation to the delay compared to the scheduled arrival time at the final destination, understood as the destination of the last flight taken by the passenger concerned.
In accordance with the regulations establishing the common rules for compensation and assistance to passengers on air flights, the amount of compensation is set from € 250 to € 600, depending on the distance of the flights. Its allocation is not subject to compliance with the conditions giving entitlement to assistance and care measures.

In accordance with European regulation n ° 261/2004 of 11/2/2004 and the judgment of the ECJ of November 19, 2009 (Aff C 402/07), you can ask the company to compensate you for the inconvenience that you caused.
Since February 17, 2005, air passengers of European carriers (dry flights or organized trips) have been better compensated in the event of denied boarding or cancellation thanks to the entry into force of European Regulation No. 261/2004 of 11 / 2/2004. The provisions of this text have been extended to aircraft delays by the Court of Justice of the European Communities. The CJEC thus estimated in a decision of November 19, 2009 (CJEC, Nov 19, 2009 – Aff C 402/07) that a very significant delay, with regard to the scheduled arrival time, should be analyzed as a cancellation and opened the right to compensation under the same conditions as a flight cancellation.
Consequently, if your flight arrives more than three hours late, you can request compensation, the amount of which depends on the distance of the flight. In the European Union: Up to 1,500 km: € 250 More than 1,500 km: € 400 Between an airport in the European Union and an airport outside the EU: Up to 1,500 km: € 250 From 1,500 at 3,000 km: € 400 More than 3,500 km: € 600 If the carrier offers another flight at a similar time, the compensation may be reduced by half. The carrier must, moreover, offer the stranded traveler at the airport two telephone calls (or fax, or electronic messages), refreshments, meals and, if necessary, accommodation at the hotel If the air carrier fails to his obligations the air passenger can ask to be compensated for all of his material and moral prejudice which he has suffered without application of the compensation ceiling. Non-pecuniary damage can thus be compensated.
Other rights to claim
If you are more than 5 hours late by plane, you have the choice between
– request the reimbursement of the ticket price for the part of the journey that is unused or has become useless, provided that this reimbursement is requested within 7 days, as well as a return flight, if applicable, to your initial point of departure in soon as possible ;
– obtain a flight to your final destination under comparable transport conditions, as soon as possible; – take another flight to your final destination under comparable transport conditions, at a later date, which you have chosen, subject to seat availability.
Delayed boarding does not in principle give entitlement to automatic compensation.
