Theft of Iberia Express overbooked? How do you successfully complete your claims process?

For passengers, the biggest fear when they fly is the cancellation of their flight and of course the delays because they don’t want to lose a single crumb of their vacation.

We suggest you via this site to review your rights in the event of cancellation or delay of your flight with Iberia Express (and even establish your compensation request via a form). We don’t always know, but you have rights.

In which case can you obtain compensation in the event of delay or cancellation of my flight?

– For a flight of 2 hours or more or for flights of 1500 kilometers or less,

– For a flight of 3 hours or more and whose distance is between 1500 and 3500 kilometers,

– For intra-community flights of more than 1,500 kilometers (metropolitan flights – DOM TOM),

– For flights of 4 hours and more and for flights of more than 3,500 kilometers.

In addition, if your flight with the Spanish low cost is canceled or delayed by at least five hours, you can request a refund for your plane ticket if you give up your trip. Likewise, you can request pick-up for the return flight to the original departure airport.

What compensation can you claim, including overbooking?

– 250 € for journeys of 1,500 kilometers or less,

– 400 € for those between 1,500 and 3,500 kilometers and for all intra-Community flights of more than 1,500 kilometers ,

– 600€ beyond 3,500 kilometers for non-EU destinations.
In the event of a delay, your airline is required (from 2 hours delay) to provide you with refreshments and food, 2 phone calls and to accommodate you if the departure cannot take place before the next day.

Keep all invoices inherent to the cancellation, they will be attached to your claim.

Iberia Express is required to pay compensation in cash or by any other means (check, transfer, etc.). Compensation in the form of travel vouchers or credit notes can only be made with the written consent of the passenger.

Are there any exceptions to this rule?

– If the delay or cancellation has not been notified at least 14 days in advance,

– You cannot claim compensation in cases of force majeure such as severe weather conditions,

– During the air traffic controllers’ strike,

– Coup in the country of destination,

– Emergency landing due to storm,

– Closure of airspace.

Please note: strike by airline or airport staff is not considered force majeure, so you must be compensated.
The compensation may depend on the nationality of the company operating your flight (European or not) and the country of departure of your flight, we explain with a specific example:

For example, a Paris-Montreal flight, operated by a non-European company (Air Transat, Air Canada), may be eligible for compensation, but a Montreal-Madrid flight, operated by the same company, is not compensable.

However, a Montreal-Madrid flight operated by a European airline such as Iberia Express is eligible for compensation.

Basically, you have the right to be compensated if:

– You arrive at your destination more than 3 hours late,

– The reason for the delay is not a case of force majeure,

– The company is responsible for this delay,

– The company informed you of this delay at least 14 days before,

– You arrived on time at check-in.

Note: From 2 hours late, the airline must provide snacks and drinks, possibility of telephone call and accommodation if the flight is not the same day.

The amount of compensation will be (including for overbooking):

– 250 € for journeys of 1,500 kilometers or less

– 400 € for those between 1500 and 3500 kilometers

– 600 € beyond 3,500 kilometers for non-EU destinations.
