Delay or cancellation of your flight by Pobeda Airlines: how to obtain compensation?
Any delay of two hours or more as well as cancellations must be compensated by the airlines including Pobeda Airlines. The rules are strict.
In recent years, disruptions at French airports have increased by 55.9%. But do you know? If you are flying during this Christmas holiday period, or at any other time of the year, you are entitled to compensation provided by the European Union in the event of flight delay or cancellation.
To qualify, you must first meet one of the following two conditions. The flight concerned, whatever the nationality of the company, must depart from an airport in one of the 28 countries of the European Union or from a Norwegian, Icelandic or Swiss airport. If not, your flight must go to the EU, Norway, Iceland or Switzerland. In this specific case, the airline must be of European nationality. If you meet one of these two criteria, everything will then depend on the extent of the delay.
The rights of air passengers increasingly recognized by Europe
For the Court of Justice of the European Union, the right to compensation in the event of flight delay applies to connecting flights, even when the delayed flight is operated by another airline. Each passenger concerned must be able to obtain another means of transport and claim compensation of up to € 600, explains the specialists in compensation for air consumers.
As a reminder, the Court of Justice of the European Union published a few months ago a decision on the interpretation of the rights of European air passengers.
The judgment of the CJEU in case C-502/18 CS against Ceské aerolinie means that the protection which European law grants to air passengers extends to all flights which leave the EU and which are booked under the same reservation reference, even if the delay is due to a subsequent correspondence by another company.
Experts and specialists in air passenger law believe that this decision is a real change which has a significant impact on the rights of air passengers throughout Europe. For the first time, one airline may be held liable for the errors of another and in the obligation to compensate. However, from the passenger’s point of view, it makes sense that the passenger can claim the ticket from the airline that sold it. They expect, however, that many companies will oppose this decision, as is usually the case when the rights of their customers are strengthened.
Compensation can go up to 600 euros. Indeed, the airline operating the disturbed flight (in the case of Pobeda Airlines) should offer the passengers concerned another means of transport if the two flights booked together under the same booking reference. In addition, the airline company must also pay passengers compensation between 250 and 600 euros if the passenger arrives at the final destination more than three hours late when the missed connection is due to a delay on a previous flight. Passengers may also be entitled to compensation if a connection is missing when they are denied boarding or if their first flight has been canceled. If the cause is a cancellation, the total delay to the final destination must not be more than 3 hours.

Faced with the paperwork demanded by certain files, some do not even attempt the adventure while the law obliges airlines to reimburse or physically compensate their customers (at least 250 euros, except in cases of force majeure).
