Denied boarding on an Azur Air flight against the passenger’s will
For flights whose passengers are protected by European regulation EC n ° 261/2004, the airline which refuses a passenger to board against their will is required to respect 3 passenger rights defined in the regulation: right to reimbursement or re-routing, right to care, right to compensation.
Right to reimbursement or re-routing
Are you denied boarding? You can choose between:
– Abandon your trip and get a refund for your plane ticket,
– Continue your trip as soon as possible on another flight offered by the airline,
– Reschedule your trip to another date of your choice, subject to the availability of seats.
If you choose to reimburse your plane ticket, the airline has 7 days to reimburse you for flights not carried out. In the event of denied boarding on a connecting flight, the company must also reimburse unnecessary flights and redirect you as soon as possible by a return flight at its expense to your original departure airport.
If you choose to continue your trip as soon as possible and the company offers you a flight to a different airport from the one originally planned, it must bear the transfer costs between the arrival airport and the airport originally planned or another nearby destination agreed with it.
Right to care
If you have opted for the continuation of your journey as soon as possible or for the reimbursement of your plane ticket and a return to your original departure airport when denied connecting boarding, the airline must take you in charge while awaiting your re-routing.
The management of the company consists of the provision of meals, refreshments and accommodation taking into account the length of the wait and the time of day or night. Transport between the airport and the place of accommodation is also the responsibility of the company, as are the costs of 2 phone calls or emails.
It is up to Azur Air to organize this support. If it does not do so, the company must reimburse you for your reasonable and justified costs.
Right to compensation
– The compensation is a lump sum, its amount depends on,
– The distance of the journey to the final destination,
– And delay in arriving at your final destination if you have opted to continue your journey as soon as possible.
Compensation cannot be paid to you in the form of purchase vouchers without your consent.
If you have opted for reimbursement of the plane ticket, the compensation comes in addition to this reimbursement.
Contact the carrier’s customer service to claim your payment, or entrust this mission to a passenger compensation specialist who will do all the procedures for you.
