Widerøe plane delay: Eligibility for compensation
Example 1: Mr. A. buys a plane ticket to go from Oslo to Bangkok on a direct flight. As the plane could not take off on time, it arrived more than 3 hours late in Bangkok compared to the original schedule. Mr. A. will be entitled to compensation according to the thresholds provided for by European Regulation (EC) no 261/2004 (1).
Example 2: Mr. B. is traveling by plane from Oslo to Bangkok with a stopover in Amsterdam. The plane takes off from the capital of Norway 2 hours late, Mr. B. misses his connection in Amsterdam, so he takes another flight and finally arrives more than 10 hours late in Bangkok. Mr. B. will not be compensated either by airline X (Oslo-Amsterdam), or by company Y (Amsterdam-Bangkok).
Why this difference in treatment? However, European regulations stipulate: “Passengers whose flight has been delayed may be compensated if they reach their final destination 3 hours or more after the scheduled arrival time. “In the case of Mr. B., Company X certainly delayed him for his correspondence, but the delay was less than 3 hours.
To remedy this injustice, the Court of Justice of the European Union (judgment in case C-11/11) has decided that passengers on connecting flights must be compensated if they arrive 3 hours or more late by compared to the estimated time of arrival at their final destination. And even if, according to the Court, “the passenger was delayed on departure by a period of time below the thresholds set by the regulations”.
What reconcile Mister A. and Mister B.
The compensation provided for in Regulation (EC) No 261/2004:
– Up to 1,500 km: 250€
– Intra-Community flights from 1,500 to 3,000 km and other flights from 1,500 to 3,500 km: 400€
– Other flights: 600€

The procedure for reimbursement and compensation is such a bureaucratic headache that few individuals start it or go through with the process. So much so that unclaimed compensation in Europe would reach 400 million euros per year.

Traveling aboard a Widerøe plane imposes very strict behavior rules on passengers, each of which perfectly measures safety issues. However, the traveler who is reminded of his duties, is also a client who now can count on precious support to assert his rights.
These are clearly laid down in Regulation EC 261/2004 established by the European Parliament and the Council in February 2004. For flights departing from Europe, regardless of the airline, compensation is due to passengers in the event of a delay of more than three hours, but also in certain cases of flight cancellation or denied boarding. For flights arriving on European soil, complaints are only possible with European airlines.
